Your privacy is important to us. Kulture Inc. ("Kulture" or "We") respects your privacy and is committed to protecting it through our compliance with this policy. 

This policy describes the types of information we may collect from you or that you may provide when you download, install, register with, access, or use our mobile applications, including without limitation those which may provide dedicated non-browser-based interaction (collectively, the “Services”), whether as a guest or a registered user and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect on or through the Services, or otherwise by or through email, text, and other electronic messages between you and the Services.

It does not apply to information collected by us offline or through any other means, or any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Services.
These other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to download, register with, or use our Services. By accessing, downloading, registering with or using the Services, you acknowledge this privacy policy. This policy may change from time to time. Your continued use of the Services following the posting of changes constitutes your acknowledgement of those changes. 
Children Under the Age of 13
Our Services are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Services. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Services or through any of its features or register on the Services, make any purchases through the Services, use any of the interactive or public posting or comment features of the Services, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Information Outside of the United States 
The Services may be stored and processed in the United States and are intended only for users located in the United States, except for residents of or people located in the state of California. If you are a resident of or located in California or the European Union or elsewhere outside of the United States, please do not use the Services or provide any information to us or otherwise through the Services. Be aware that information we collect will be transferred to and processed in the United States. By using the Services or providing us with any information, you acknowledge this transfer and any related transfer and processing of information in the United States.
Information We Collect About You and How We Collect It
We collect several types of information from and about users of our Services, including information:
by which you may be personally identified, such as name, postal address, e-mail address, payment information, telephone number, or any other identifier by which you may be contacted online or offline ("personal information"); and/or
that is about you but individually does not identify you.
We collect this information:
Directly from you when you provide it to us.
When you download, register with, or use the Services.
Automatically as you navigate through the Services. Information collected automatically, by way of example, may include usage details, IP addresses, device information, location and information collected through cookies, web beacons, and other tracking technologies.

The information we collect on or through our Services may include:
Information that you provide by filling in forms on our Services. This includes information provided at the time of registering to use our Services, subscribing or otherwise creating an account, posting material, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you submit a request, report a problem with our Services.
Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
Your responses to surveys that we might ask you to complete.
Your search queries on and other interactions through the Services.

You also may provide information to be published or displayed (hereinafter, "posted") on public and certain log in restricted areas of the Services, or transmitted to other users of the Services or third parties (collectively, "User Contributions"). Your User Contributions are posted on the Services and transmitted to the Services and others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information We Collect Through Automatic Data Collection Technologies  
As you navigate through and interact with our Services, we may use automatic data collection technologies to collect:
 Usage Details. When you access and use the Services, we may automatically collect certain details of your access to and use of the Services, including, traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Services.
Device Information. We may collect information about your mobile device and internet connection, including your device’s unique device identifier, IP address, operating system and browser type, mobile network information, and the devices’ telephone number.
Stored Information and Files. The Services also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
If you do not want us to collect this information do not download the App or delete it from your device. 
We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). 
The technologies we use for this automatic information collection may include:
Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. 
Web Beacons. Certain portions of our Services and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Kulture, for example, to count users who have visited those pages or opened an email and for other related Services statistics (for example, recording the popularity of certain content and verifying system and server integrity).

Essential Cookies: Allow you to navigate and use the features provided by our Services.

Functional Cookies: These cookies customize elements of the promotional layout and/or content of the pages of the Services and remember that you have visited us before; this means we can identify the number of unique visitors we receive. This allows us to make sure we have enough capacity for the number of users that we get.  Thus, when you use our Services, we remember you and your preferences and information you have submitted to us to provide you with a customized experience.

Performance and Analytics Cookies: Performance cookies let us collect information about how you use the Services. They collect statistical information about how you use the Services (including how long you spend using the Services), so that we can improve the Services and learn which functions of the Services are most popular with users. We may associate such information with user accounts and personal information once we receive it from the third party.

Advertising and Targeting Cookies: These cookies collect information about the pages you visit online. They gather information about the pages that you visit or the functions of the Services that you use, and also other information about other websites that you visit, so as to place you in a “market segment”. This information is only collected by reference to the IP address or unique device identifier that you are using (the applicable cookie identifier) and also can include information about the county or province and city or town you are in, together with the name of your internet service provider. This information is then used to place interest-based advertisements throughout the Services, which it is believed will be relevant to your market segment. This may result in you seeing advertisements for our Services when you visit other websites.

Third-Party Information Collection
Some content or applications, including advertisements, on the Services are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. 
We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information:
To provide you with the Services and related contents, and any other information, products, support, or other services.
To fulfill any other request or purpose for which you provide it.
To provide you with notices about your account.
To conduct research and improve the Services.
To perform marketing services, including, among others, analyzing trends in marketing.
To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
To notify you when updates to the Services are available, and of changes to our Services or any products or services we offer or provide though the Services.
To allow you to participate in interactive features on our Services.

The usage information we collect helps us to improve our Services and to deliver a better and more personalized experience by enabling us to:
Estimate our audience size and usage patterns.
Store information about your preferences, allowing us to customize our Services according to your individual interests.

Recognize you when you use the Services.
We use location information we collect to implement geofencing.

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. 
In addition, we may disclose personal information that we collect or you provide as permitted by applicable law, and as described in this privacy policy:
To our subsidiaries and affiliates.
To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Kulture’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Kulture about our Services users is among the assets transferred.
To fulfill the purpose for which you provide it. For example, if you use any feature of the Services permitting you to communicate with third parties (such as to invite a contact to the Services), we reserve the right to identify you as the person who has made the referral in any messages that are sent to them.

Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 
Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent; however, due to the varying practices of organizations that offer browsers and the lack of a standard in the marketplace, we generally do not respond to do not track (“DNT”) signals sent via browsers at this time. In general, our system will issue cookies when you direct your browser to our Services. 
Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending us an email to [social@kulture.com]. 
Promotional Offers from Kulture. If you do not wish to have your information used by Kulture to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to [social@kulture.com]. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to Kulture as a result of a product purchase, donation, service experience or other transactions.
Accessing and Correcting Your Information
You can review and change certain of your personal information by logging into the Services and visiting your account profile page, or by sending us an email at social@kulture.com. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Services users. Proper access to and use of information provided on the Services, including User Contributions, is governed by our terms of use [kulture.com/termsofservice].

Data Sharing
• Customer data is not shared with 3rd parties for promotional or marketing purposes.
• Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.
Kulture Inc. Messaging Terms and Conditions
1. The messaging program consists of general conversational messaging to answer questions and provide support to customers.
2. You can cancel the SMS service at any time. Just text 'STOP' to the phone number from which you received messages. After you send the SMS message 'STOP' to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at social@kulture.com.
4. Carriers are not liable for delayed or undelivered messages.
5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency will vary based on communication needs. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Data Security
The security of your personal information is important to us. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. The information you share in public areas may be viewed by any user of the Services, including, without limitation, the subject topic of all messages sent.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we implement reasonable security in the Services to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.
Your California Privacy Rights
Although California Residents are prohibited from using the Services, the California Civil Code Section § 1798.83 permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Changes to Our Privacy Policy
The date the privacy policy was last revised is identified at the top of the privacy policy. It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Services home page. If we make material changes to how we treat our users' personal information, we will use commercially reasonable efforts to notify you through the Services, or by email to the primary email address specified in your account. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Services and this privacy policy to check for any changes.
